About Kenneth
Ken Webster works at the forefront of healthcare litigation and consultation in Nevada and California. His practice focuses primarily on medical malpractice defense for institutional clients, including acute care hospitals, ambulatory surgery centers, long-term care facilities, rehabilitation centers, and other healthcare organizations.
Ken also advises clients on policy development, regulatory compliance, Joint Commission considerations, and the FDA clinical trial process. His clients include healthcare facilities, clinical research organizations, and other institutional entities.
Ken has significant experience in all phases of high-exposure medical malpractice litigation and has taken numerous cases to trial as both first- and second-chair counsel. His experience includes matters involving neurologic injury, birth trauma, wrongful death, dismemberment, sexual assault, decubitus ulcers, and premises liability. He has also handled numerous mediations and arbitrations, argued before the U.S. District Court for the District of Nevada and the Nevada Supreme Court, and represented clients before regulatory and licensing boards.
In addition to his legal practice, Ken has served as a healthcare executive. He was CEO of United Cancer Centers, an emerging Right-to-Try network of cancer clinics focused on providing investigational treatments to terminal cancer patients. During that time, he also served as CEO of CHIPSA Hospital, an immunotherapy research cancer hospital in Playas de Tijuana, Mexico. His experience as both outside counsel and a healthcare administrator provides him with a unique perspective on the operational needs of healthcare organizations and the defense of those entities in litigation.
Ken also performed the discovery and motion work in two significant Nevada appellate matters. In Guardianship of L.S. & H.S., he successfully navigated issues involving parental consent for the administration of blood products despite religious objection. In Monroe v. Columbia Sunrise Hospital and Medical Center, he successfully moved to dismiss a birth trauma case for failure to comply with Nevada’s requirement that the case proceed to trial within five years, a decision later upheld by the Nevada Supreme Court.
Ken provides risk-management support to healthcare clients and has spoken on numerous occasions at Grand Rounds for local hospitals and ambulatory surgery centers. He works closely with clients to reduce litigation exposure through improvements to policies, practices, and procedures.
Ken has been recognized as one of Nevada’s Top Lawyers and as a Mountain States Super Lawyer in medical malpractice litigation. He has also received Martindale-Hubbell’s highest peer-review rating and has served on committees focused on developing discovery practices and specialized jury instructions for medical malpractice cases in Nevada.
After earning his law degree from Vermont Law School in 1999, Ken practiced for 27 years at two Las Vegas law firms before joining Ferrainolo Allen.
